UPON the Applicant’s filing of a Notice of Commencement of Assessment on 5 May 2020 claiming an amount of AED 680,565 in its bill of costs (“Bill of Costs”)
AND UPON the Applicant’s request pursuant to its email of 5 May 2020 and further explanatory email of 7 May 2020 that 50% of its costs be payable on account before costs are assessed (the “Request”)
AND UPON considering Practice Direction No. 5 of 2014 DIFC Courts’ Costs Regime
AND UPON the Order of H.E. Justice Shamlan Al Sawalehi issued on 14 May 2020 rejecting the application for a stay, filed by the Defendant on 7 May 2020
AND UPON taking into account all other relevant documents on the court file
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Respondent is ordered to pay a total AED 340,282.5, into Court, within 14 days of the issuance of this Order and by Sunday, 31 May 2020. This amount represents 50% of the total amount claimed by the Applicant in its Bill of Costs.
