UPON reviewing the Court file
AND UPON reading the Case Management Bundle
AND UPON reviewing the Rules of DIFC Courts (“RDC”)
AND UPON the parties confirming to the DIFC Courts’ Registry that all case management directions have been agreed
AND UPON hearing from counsel for the Claimants and the Defendants at the CMC on 9 June 2020
IT IS HEREBY ORDERED THAT:
Trial
1. There shall be a trial limited to issues of liability and injunctive relief only (“the Liability Trial”). The Liability Trial is to take place in the DIFC Court of First Instance, with a time estimate of 5 days from 6-10 September 2020.
2. There shall be directions for the Liability Trial as set out below.
Production of Documents (RDC Part 28)
3. By 4 pm on 11 June 2020, the parties shall each:
a. make a reasonable search for documents which adversely affect their own case or that of another party and/or support another party’s case;
b. provide a list of all documents upon which they rely, including public documents and those in the public domain, and of all other documents identified in accordance with the search in paragraph 3(a) above;
c. provide a copy of all documents so listed or (in the event that a party seeks to exclude any document from production) state any claim to any right or duty to withhold production in accordance with RDC 28.29;
in each case, limited to the issues of liability and injunctive relief.
For these purposes, “document” has the meaning given in RDC 28.1 and 28.2.
Evidence (RDC Part 31)/ADR
4. By 4 pm on 6 August 2020, the parties shall file and exchange witness statements limited to the issues of liability and injunctive relief.
5. By 4pm on 24 August 2020, the parties shall file and exchange reply witness statements.
6. No expert evidence being necessary for the Liability Trial, no party has permission to rely upon expert evidence.
General
7. Parties to agree the trial bundle index by 4 pm on 13 August 2020. The Claimants shall provide a copy of the trial bundle to the Defendants by 4pm on 20 August 2020.
8. The Claimants shall file the trial bundle at Court by 4pm on 1 September 2020.
9. The parties shall file and exchange skeleton arguments by 4pm on 1 September 2020.
10. There shall be liberty to apply.
11. The parties may agree in writing to vary the dates for compliance with these directions by up to 14 days without the need to apply to the Court provided that the variation does not jeopardise the trial date.
Costs
12. Costs of the Case Management Hearing are costs in the case
