UPON the Order of Judicial Officer Maha Al Mehairi dated 8 June 2020 (the “Order”) ordering the Defendant to produce all documents in response to each of the Claimant’s Request to Produce dated 21 May 2020 (the “Decision of the Judicial Officer”)

AND UPON the Defendant’s Application dated 11 June 2020 for a de novo review of the Decision of the Judicial Officer (the “Application”) pursuant to Practice Direction No. 3 of 2015 – Review of DIFC Courts Officer and Registrar Decisions.

AND UPON the Court having read the Application, and the Claimant’s reply to the Application filed on 21 June 2020

AND UPON the having read the papers filed on the Court record

IT IS ORDERED THAT:

1. The Application is granted.

2. The Decision of the Judicial Officer Maha Al Mehairi dated 8 June 2020 is hereby quashed.

3. Cost in the Case.

4.Liberty to apply.

SCHEDULE OF REASONS

I find that the Claimant’s Request to Produce filed on 27 May 2020 is too broad on the basis that it does not include either a description of a requested document sufficient to identify it or a description, in sufficient detail, of a narrow and specific requested category of documents.

The Claimant’s Request also failed to meet the mandatory criteria set out in RDC 28.1.
