CONSENT ORDER


UPON the judgment of H.E. Justice Ali Al Madhani issued on 26 June 2018 awarding the Defendant/Respondent its costs of the immediate judgment application filed by the Claimant/Appellant (the “Immediate Judgment Costs Order”)

AND UPON the judgment of H.E. Justice Ali Al Madhani issued on 5 September 2019 awarding the Defendant/Respondent its costs of the proceedings in the Court of First Instance (the “First Instance Costs Order”)

AND UPON the judgment of Justice Sir Jeremy Cook, Justice Wayne Martin and H.E. Justice Shamlan Al Sawalehi awarding the Defendant/Respondent its costs of the proceedings in the Court of Appeal (the “Court of Appeal Costs Order”)

AND UPON the application of the parties

AND UPON the parties having agreed to the terms set out in a confidential settlement agreement dated 28 May 2020 (the “Settlement Agreement”), copies of which are held by the Parties’ solicitors

BY CONSENT IT IS DECLARED THAT:

1. The Claimant/Appellant’s liability in connection with the Immediate Judgment Costs Order, the First Instance Costs Order and the Court of Appeal Costs Order has been fully and finally satisfied and discharged under the terms of the Settlement Agreement.

2. The Defendant/Respondent’s Application Notice No. CFI-018-2018/2 dated 20 October 2019 for an interim payment on account of the First Instance Costs Order shall be dismissed.

3. No order as to costs.
